How long does trademark registration take in India?
The typical timeline is 8-12 months if there are no objections or oppositions. You receive a filing receipt and TM number within 1-2 days of application, which allows you to use the ™ symbol immediately.
What can be registered as a trademark?
Words, logos, slogans, sounds, shapes, colours, and even smell can be registered — as long as they are distinctive and capable of distinguishing your goods/services from others. Brand names, product names, and taglines are the most common.
What is the difference between ™ and ®?
™ indicates a trademark claim (can be used immediately upon filing). ® indicates a registered trademark — this can ONLY be used after the mark is officially registered by the Registry. Using ® without registration is a punishable offence.
Do you handle cases outside Gujarat?
Yes, trademark registration is a central process — I file applications at the appropriate Trademark Registry office regardless of your location. Consultations are available virtually, and I serve clients across India.
What documents are needed for trademark filing?
Basic requirements include: Applicant's identity/address proof, the trademark (word or logo), list of goods/services, and a signed Form TM-48 (Power of Attorney). For companies: Certificate of Incorporation. I guide you through the entire documentation.
What can be protected under Industrial Design registration?
Any new or original shape, configuration, pattern, or ornamentation applied to an article by an industrial process can be registered. This includes product packaging, furniture designs, mobile phone casings, jewellery patterns, and textile designs. The design must be novel and not previously published in India.
How long does Design registration remain valid?
A registered design is initially valid for 10 years from the date of registration. It can be renewed for a further period of 5 years (total 15 years). After 15 years, the design enters the public domain.
What works can be protected under Copyright?
Copyright protects original literary works (books, articles, code), artistic works (paintings, photographs, logos), musical compositions, sound recordings, cinematographic films, and dramatic works. Copyright subsists automatically upon creation, but registration provides legal evidence of ownership.
Is copyright registration mandatory in India?
No, copyright exists automatically upon creation of the work. However, registration is highly recommended as it serves as prima facie evidence of ownership in court, makes enforcement easier, and is essential when dealing with infringement disputes or licensing agreements.
How long does copyright protection last?
For literary, dramatic, musical, and artistic works, copyright lasts for the lifetime of the author plus 60 years. For photographs, films, sound recordings, and posthumous publications, it lasts 60 years from the date of publication.
